          Abstract

          Resumen Se comenta la sentencia dictada por el 3er Juzgado de Policía Local de Maipú, confirmada íntegramente por la Corte Suprema, en la cual, tras una labor interpretativa, que implicó analizar diversos elementos de la promesa de compraventa que la consumidora celebró con un cementerio, se determinó que el negocio, en realidad, se asemejaba a un leasing, e incluía la prestación de un producto financiero, siendo posible aplicar las disposiciones de la Ley n.° 18010 junto a las de la Ley n.° 19496. Si bien dicha calificación buscó otorgar una mayor protección al consumidor frente a lo que puede considerarse un producto financiero encubierto, el concepto de “crédito directo” permite explicar de mejor manera el negocio y entender que la operación realizada se trata de un préstamo de dinero, cuya peculiaridad, en este caso, es su entrega de forma ficta al consumidor.

          Translated abstract

          Abstract This article presents a commentary about the decisión of the 3rd Local Police Court of Maipú, confirmed by the Supreme Court, in which, after analyzing various elements of the promise of sale that the consumer contracted with a cemetery, it was determined that the business was, actually, similar to a leasing, and included the provision of a financial product, being possible to apply rules of Law No. 18.010 in conjunction with Law No. 19.496. Although this qualification allows greater protection to the consumer against what may be considered a hidden financial product, the concept of “direct credit” allows a better explanation of the contract, allowing to understand that the operation carried out is a money loan, but it’s granted in a fictional way to the consumer.
