          Abstract

          Resumen La Constitución ecuatoriana de 2008 elevó a las políticas públicas a garantías constitucionales de derechos, junto con las normativas y jurisdiccionales. El legislador constituyente pudo haber previsto parcialmente consecuencias de hacerlo; sin embargo, es en la práctica que se da su desenvolvimiento pleno. El entrecruzamiento de garantías jurisdiccionales con garantías de política pública se materializó en 2011, cuando dos organizaciones de la sociedad civil que agrupan personas portadoras del virus de inmunodeficiencia humana (VIH) presentaron una petición de medidas cautelares, la cual fue resuelta por un juez de primera instancia en la provincia del Guayas, quien ordenó al Ministerio de Salud Pública que reformule una de sus políticas. Este mecanismo de judicialización trastoca fórmulas ortodoxas de entender la política pública y el involucramiento del poder judicial en su ciclo. Este caso sirve para desvirtuar objeciones al involucramiento del judicial en ámbitos considerados privativos del ejecutivo y el legislativo. Las repercusiones de ello trascienden el campo de los derechos sociales y pueden conducir de forma eventual al pronunciamiento de la justicia sobre otros ámbitos.

          Translated abstract

          Abstract The Ecuadorian Constitution of 2008 recognized public policies as constitutional rights guarantees, along with the normative and jurisdictional ones. The constitutional legislator may have partially foreseen consequences of doing so; however, it is through practice that they fully develop. The intertwining of jurisdictional guarantees with guarantees of public policy came together in 2011, when two civil society organizations of people with HIV filed a request for precautionary measures, which was resolved by a judge of first instance in the province of Guayas, who ordered the Ministry of Public Health to reformulate one of its policies. These judicial actions overturn orthodox formulas of understanding public policies and the involvement of the Judiciary in their cycle. This case serves to distort objections to the involvement of the Judiciary in areas considered exclusive to the Executive and Legislative branches. The repercussions of this transcend the field of social rights and can lead eventually to the pronouncement of justice on other fields.
