          Abstract

          En este artículo se revisan los argumentos que justificaban el ejercicio del patronato indiano por parte de la corona española y se analizan las discusiones que surgieron a la hora de legitimar las mismas prerrogativas en manos de los gobiernos que se erigieron tras la crisis de la monarquía en Río de la Plata, hasta la organización constitucional a mediados del siglo XIX. Se intenta demostrar que las controversias del periodo independiente responden al cambio sustancial en el modo de entender la soberanía experimentado durante ese lapso, entendido como el tránsito de una monarquía legitimada confesionalmente a la constitución de una nación republicana y federal.

          Translated abstract

          This article reviews the arguments that justified the exercise of Spanish-American patronage by the Spanish Crown and analyzes the discussions that arose when it came to legitimizing the same prerogatives in the hands of governments that sprang up in the wake of the crisis of the monarchy in River Plate, until the constitution was organized in the mid-19th century. The article seeks to show that the controversies of the independent period reflect the substantial change in the way of understanding the sovereignty experienced during this period, understood as the shift from a monarchy that had been legitimized confessionally to the constitution of a republican and federal nation.
