          Translated abstract

          Forced hospitalization is a common practice in psychiatry. It involves limiting the patient’s freedom of movement in a clinical context without expressing informed consent, causing stress to the family and support network. Thus, forced hospitalization may cause violations, disturbances, or threats to the human rights of a vulnerable population. Considering this clinical reality, the present study seeks to analyze the current law on this subject in Chile compared to the international human rights guidelines. The analysis included a review of legal documents and referenced scientific articles. The new law No. 21,331 establishes a more demanding standard for the origin of forced internment, shortening the distance concerning the human rights guidelines regarding intellectual disability. The incoming development of the regulations mandated by the law could fill in the gaps in several situations that may arise and clarify fuzzy points. The key stakeholders’ participation level will be critical in this matter.

              Tratamiento ambulatorio involuntario en psiquiatría: una revisión desde la bioética

              La libertad es un derecho fundamental de las personas y dentro de ellas está la libertad de poder decidir sobre el tipo de tratamiento al que nos someteremos por una enfermedad. Esta libertada está consagrada en diferentes leyes a través del principio del consentimiento informado. Pero, en el campo de la psiquiatría nos podemos encontrar con pacientes que tienen disminuida de manera temporal o permanente su capacidad de decidir sobre su tratamiento. Muchas de estas personas acaban siendo ingresadas de forma involuntaria en unidades de hospitalización cerradas. En muchos países existe legislación que permite realizar tratamientos ambulatorios involuntarios en casos que delimite la ley y salvaguardando los derechos de los pacientes. En España la situación legal del tratamiento ambulatorio involuntario no está resuelta. En este artículo se analizará la situación legal actual en España, los diferentes tipos de tratamientos ambulatorios involuntarios, los argumentos a favor y en contra de ellos y se defenderá la necesidad de regularlo.
