      Canada’s legal preparedness against the COVID‐19 Pandemic: A scoping review of federal laws and regulations

          Abstract

          As the world continues to grapple with the COVID‐19 pandemic, the preparedness of governments to respond to it will likely undergo review. A key component is the legislative capacity and authority that governments had in place or could rapidly introduce to address the social, economic and health consequences of the emergency. We review Canada’s legal preparedness for public health emergencies and the use of federal legislation to address the pandemic. We provide an overview of the concept of legal preparedness, summarize the federal statutes, regulations and orders enacted, and analyze the coherence of federal activity and its relevance to provinces, territories and international health regulations. We determine that the federal government has relied on spending power rather than constitutional authority over public health or existing legislation on influencing the course of the pandemic.

          Alors que le monde entier ne cesse de lutter contre la pandémie de COVID‐19, le dispositif de veille et de préparation des gouvernements fera probablement l'objet d'un examen. La capacité et l'autorité législatives que les gouvernements avaient en place ou pourraient instaurer rapidement pour faire face aux conséquences sociales, économiques et sanitaires de l'urgence est un élément clé. Nous passons en revue la préparation légale du Canada aux urgences de santé publique et l'utilisation de la législation fédérale pour lutter contre la pandémie. Nous présentons un aperçu du concept de préparation légale, résumons les lois, règlements et décrets fédéraux adoptés et analysons la cohérence de l'activité fédérale et sa pertinence pour les provinces, les territoires et les règlements sanitaires internationaux. Nous établissons que, pour influencer l’évolution de la pandémie, le gouvernement fédéral a plus compté sur le pouvoir de dépenser que sur l'autorité constitutionnelle concernant la santé publique ou la législation existante.

          Systematic review or scoping review? Guidance for authors when choosing between a systematic or scoping review approach

          Background Scoping reviews are a relatively new approach to evidence synthesis and currently there exists little guidance regarding the decision to choose between a systematic review or scoping review approach when synthesising evidence. The purpose of this article is to clearly describe the differences in indications between scoping reviews and systematic reviews and to provide guidance for when a scoping review is (and is not) appropriate. Results Researchers may conduct scoping reviews instead of systematic reviews where the purpose of the review is to identify knowledge gaps, scope a body of literature, clarify concepts or to investigate research conduct. While useful in their own right, scoping reviews may also be helpful precursors to systematic reviews and can be used to confirm the relevance of inclusion criteria and potential questions. Conclusions Scoping reviews are a useful tool in the ever increasing arsenal of evidence synthesis approaches. Although conducted for different purposes compared to systematic reviews, scoping reviews still require rigorous and transparent methods in their conduct to ensure that the results are trustworthy. Our hope is that with clear guidance available regarding whether to conduct a scoping review or a systematic review, there will be less scoping reviews being performed for inappropriate indications better served by a systematic review, and vice-versa.

            What are scoping studies? A review of the nursing literature.

            Scoping studies are increasingly undertaken as distinct activities. The interpretation, methodology and expectations of scoping are highly variable. This suggests that conceptually, scoping is a poorly defined ambiguous term. The distinction between scoping as an integral preliminary process in the development of a research proposal or a formative, methodologically rigorous activity in its own right has not been extensively examined. The aim of this review is to explore the nature and status of scoping studies within the nursing literature and develop a working definition to ensure consistency in the future use of scoping as a research related activity. This paper follows an interpretative scoping review methodology. An explicit systematic search strategy included literary and web-based key word searches and advice from key researchers. Electronic sources included bibliographic and national research register databases and a general browser. The scoping studies varied widely in terms of intent, procedural and methodological rigor. An atheoretical stance was common although explicit conceptual clarification and development of a topic was limited. Four different levels of inquiry ranging from preliminary descriptive surveys to more substantive conceptual approaches were conceptualised. These levels reflected differing dimensional distinctions in which some activities constitute research whereas in others the scoping activities appear to fall outside the remit of research. Reconnaissance emerges as a common synthesising construct to explain the purpose of scoping. Scoping studies in relation to nursing are embryonic and continue to evolve. Its main strengths lie in its ability to extract the essence of a diverse body of evidence giving it meaning and significance that is both developmental and intellectually creative. As with other approaches to research and evidence synthesis a more standardized approach is required.

              COVID-19 as a Complex Intergovernmental Problem

              Federations increasingly face complex policy challenges, from managing climate change to mass migration. COVID-19 is a prime example of this emerging type of problem. This research note introduces the concept of complex intergovernmental problems (CIPs) to better understand these types of challenges.
