          Abstract

          En este artículo se presentan los resultados de las revisiones analíticas de los primeros escritos de Baratta relacionados con el positivismo jurídico. Nos interesa evidenciar cuál es la perspectiva desde la cual analiza la crisis del positivismo jurídico en el período posbélico y su relación con el período totalitario. Además, se busca evidenciar su actitud al confrontarse con la escuela analítica italiana, siendo él de formación idealista: de una defensa del positivismo jurídico frente a la supuesta responsabilidad en los totalitarismos del siglo XX, a partir de un juicio sereno elaborado en sus primeras monografías, a la crítica del modelo restringido de ciencia jurídica presente en sus trabajos teóricos sobre la relación ser-deber ser.

          Translated abstract

          This article presents the results of the analytical review of the early writings of Baratta related to legal positivism. We are interested in highlighting the perspective from which Baratta examines the crisis of legal positivism in the post-war period and its relationship to the totalitarian period. In addition, we seek to demonstrate the attitude of Baratta confronted with the analytical Italian school: from a defense of legal positivism in front of the alleged responsibility for the totalitarianism of the 20th century, a serene trial developed in their first monographs, to the criticism of the restricted model of legal science present in their theoretical work on the relationship between be - ought be.
