Direito penal do inimigo: quando Jakobs se aproxima de Hobbes e Freud

Abstract

O direito penal do inimigo tem sido abordado no contexto do endurecimento da lei penal pelo mundo. O objetivo deste trabalho é apresentar o denominado direito penal do inimigo e, dessa forma, realizar uma aproximação entre Günther Jakobs, Hobbes e Freud. Assim, destacaremos alguns aspectos do direito penal de Jakobs, do direito penal do inimigo e, ao final, sinalizaremos pela proximidade dos três autores.

Translated abstract

The enemy criminal law have been worked in the context of the hardening of criminal law throughout the world. The aim of this work is to present the so called enemy criminal law and to proceed a rapprochement between Günther Jakobs, Hobbes e Freud. Thus, we will highlight some aspects of Jakobs' Criminal Law, of enemy criminal law and at the end, we'll signalize to the proximity of the three authors.
