Abstract

Ao contrário do que acontece no Direito Administrativo Geral, no Direito do Urbanismo a regra geral quanto ao desvalor dos actos administrativos é a nulidade. O acto nulo não produz quaisquer efeitos jurídicos, mas podem existir sempre efeitos de facto, conduzindo a uma necessidade acrescida de tutelar a confiança gerada por esses actos. Perceber em que situações se impõe salvaguardar a situação de facto do particular e atribuir efeitos putativos, desconsiderando assim o princípio da legalidade, é o objectivo do presente artigo.

Unlike what happens in the General Administrative Law, in Planning Law general rule concerning worthlessness of administrative acts is void. Once this is characterized by the total lack of productivity of the legal effect of the act, but there may be effects of fact, it is even more necessary to safeguard the confidence generated by these acts. Perceive situations in which it must safeguard the particular factual situation and assign putative effects, thus disregarding the principle of legality, is the purpose of this Article.
